These terms govern all work carried out by Apex Performance Tuning ("Apex", "we", "us", "our") and use of our website. By booking a service, accepting a quote or instructing us to perform work, you agree to these terms.
1. Quotes and bookings
All quotes are estimates based on the information provided and the expected scope of work. Quotes are valid for 30 days unless stated otherwise. If additional work is identified during inspection we will contact you for written or recorded verbal approval before proceeding.
2. Payment
Payment is due in full on collection of the vehicle unless otherwise agreed in writing. We accept EFTPOS, credit card and bank transfer. Vehicles will not be released until payment has cleared. Storage fees may apply to vehicles left more than 7 days after notification of completion.
3. Parts and warranty
Parts fitted by Apex carry the manufacturer's warranty as supplied to us. Labour on workshop-supplied parts is warranted for 12 months or 20,000 km, whichever occurs first. Customer- supplied parts are fitted at the customer's risk and are not covered by Apex labour warranty. Performance, racing and consumable items (brake pads, rotors, clutches, tyres, fluids) are excluded from labour warranty.
4. Performance modifications and ECU tuning
Performance modifications and ECU calibrations may affect your manufacturer warranty, insurance, roadworthiness and emissions compliance. The customer is responsible for ensuring any modification is legal for their intended use and for declaring modifications to their insurer and registration authority. Apex accepts no liability for consequential failure of components not fitted, supplied or specified by Apex.
5. Engineering & compliance
Engineering certification is subject to inspection and the independent discretion of the licensed engineering signatory. Apex does not guarantee certification of any vehicle until the signatory has issued the relevant certificate.
6. Vehicle storage and risk
Vehicles left at our workshop are kept in a secured premises but remain at the owner's risk. We recommend you maintain comprehensive insurance on your vehicle at all times.
7. Liability
Nothing in these terms excludes any rights you have under the Australian Consumer Law. To the maximum extent permitted by law, Apex's liability for any claim is limited to the resupply of services or the cost of having the services resupplied.
8. Governing law
These terms are governed by the laws of Victoria, Australia.
